Welcome to Nostalgia Today! These Terms of Service ("Terms") govern your use of the Nostalgia Today website and services (collectively, the "Service"), operated by G H KICH - SISTEMAS ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service. We may modify these Terms at any time, and such modifications will be effective immediately upon posting the modified Terms on the Service. You agree to review the Terms periodically to be aware of such modifications.

2. Eligibility

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant to us that you are at least 13 years old.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Conduct and Content

You are solely responsible for your conduct and any Content that you submit, post, and display on the Nostalgia Today service.

You agree not to post Content that violates our policies (detailed below).

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
• You do not have a right to make available under any law or under contractual or fiduciary relationships;
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
• Constitutes unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
• Is from or links to webstores or e-commerce sites for the purpose of direct sales;
• Is primarily political in nature;
• Constitutes "post flooding" (i.e., submitting an excessive number of posts in a short period);
• Is a compilation or meme, unless it is original and directly relates to a specific nostalgic memory;
• Is a frequent repost of content already widely available on the Service;
• Promotes your personal YouTube channels, social media accounts, or other personal platforms for self-promotion rather than sharing a specific nostalgic memory.
• Is not "Safe for Work" (SFW).

We reserve the right, but are not obligated, to remove or modify Content for any reason, including Content that we believe violates these Terms or our policies.

5. Content Ownership and License

You retain all of your ownership rights in your Content. However, by submitting Content to Nostalgia Today, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and our (and our successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.

6. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of G H KICH - SISTEMAS and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of G H KICH - SISTEMAS.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or request account deletion. Upon account deletion, your posts and comments will be deleted. Likes will remain, as they are anonymous.

8. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. We disclaim all warranties, express or implied, in connection with the Service and your use thereof.

In no event shall G H KICH - SISTEMAS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
